Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Dahlmann Software ApS ("Trainavo," "we," "us," or "our") governing your access to and use of the Trainavo mobile application and related services (collectively, the "Service").

By creating an account, downloading the app, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

You must be at least 16 years old to use Trainavo. By using the Service, you represent that you meet this age requirement.

2. Description of Service

Trainavo is a fitness and training platform that allows you to:

• Track and analyze workouts and activities
• Plan future training sessions
• Import, sync, and export data with connected services such as Garmin Connect, Apple HealthKit, and Strava
• View detailed activity analytics and metrics
• Access optional AI-powered coaching insights

The Service may use data from third-party health, fitness, wearable, and training services ("Third-Party Sources") to generate training metrics, summaries, plans, reference information, and other features. The availability, accuracy, and functionality of Third-Party Sources are governed by those services and may change without notice.

We may modify, update, add, remove, suspend, or discontinue parts of the Service at any time, subject to applicable law and any active subscription rights you have.

3. Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://trainavo.com/privacy. The Privacy Policy explains how Dahlmann Software ApS collects, uses, stores, shares, and protects personal information, including training, health, connected-service, and AI-related data.

By using the Service, you acknowledge that information you provide or authorize us to access will be handled as described in the Privacy Policy and in any app permission or consent screens.

4. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

5. Age and Restricted Features

You must be at least 16 years old to use Trainavo. If the law where you live requires parental consent or a higher age to use certain online, health, subscription, or connected-device features, you may use those features only if the requirement is satisfied.

Some features may be restricted to users who are 18 years old or otherwise legally permitted to use them, including features involving purchases or subscriptions, sensitive health metrics, advanced AI analysis, or other features that we designate as age-restricted.

We may use technical, account, or app-store controls to limit access to age-restricted features, but we cannot guarantee every restriction will work in every circumstance. You are responsible for providing accurate age and account information.

6. User Responsibilities

When using the Service, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Upload false, misleading, or fraudulent data
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any commercial purpose without our written consent
• Reverse engineer, decompile, or disassemble the app
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other harmful code
• Misrepresent your age, identity, health status, training data, or authority to connect a third-party account
• Use the Service to provide medical, emergency, or professional healthcare services to another person

You are responsible for the content, data, settings, third-party connections, and activity associated with your account. We reserve the right to suspend or terminate your account for violations of these terms.

7. Subscriptions and Payments

7.1 Free Tier

Trainavo offers a comprehensive free tier that includes core features such as activity tracking, workout planning, device syncing, and analytics. The free tier is available indefinitely at no cost.

7.2 Supporter Tier

The Supporter tier is an optional subscription that may provide access to advanced AI coaching features and supports the ongoing development of Trainavo. The features included in any paid tier may change as we add, improve, or retire features, subject to applicable law.

7.3 Payment Terms

If you subscribe to the Supporter tier:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings

7.4 Refunds

Refunds for in-app purchases are handled by Apple in accordance with their refund policies. To request a refund, please contact Apple Support.

8. Intellectual Property

8.1 Our Content

The Service, including its design, features, content, and underlying code, is owned by Dahlmann Software ApS and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

8.2 Your Content

You retain ownership of the data and content you upload to the Service (such as activities, notes, and profile information). By using the Service, you grant us a limited, worldwide, non-exclusive license to host, store, process, transmit, display, analyze, and create derived outputs from your content only as necessary to operate, secure, support, improve, and provide the Service and as described in our Privacy Policy.

8.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use and implement such feedback without any obligation to you.

9. Third-Party Services

The Service integrates with third-party services to enhance your experience:

• Garmin Connect: Sync activities and health data from Garmin devices
• Apple HealthKit: Access workout and health data from Apple devices
• Strava: Import historical activity data

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

Garmin data is provided to Trainavo after you authorize the Garmin connection. Garmin is not responsible for data after it has been submitted to Trainavo, and Garmin does not provide Trainavo's app, support, coaching, analytics, subscriptions, or user-facing services.

You may disconnect third-party services at any time through your account settings.

10. AI Features

Trainavo may offer optional AI-powered features for training analysis, coaching-style responses, summaries, workout suggestions, and related fitness insights. These AI features are powered by OpenAI.

AI features may use information from your account, including training, activity, health, and connected-service data, only when you have given the required consent. You can withdraw AI consent in Trainavo settings, but disabling AI may not remove information that was already processed or generated before withdrawal, except as described in our Privacy Policy or required by law.

AI-generated content may be inaccurate, incomplete, delayed, or inconsistent. You are responsible for reviewing any AI output before relying on it, and you should not treat AI output as medical advice, professional coaching advice, diagnosis, treatment, or a substitute for your own judgment.

11. Health and Fitness Disclaimer

The Service provides fitness, training, analytics, and wellness information for informational purposes only. It does not provide medical, mental health, physical therapy, nutrition, or professional coaching advice. Always consult a qualified healthcare professional before:

• Starting any new exercise program
• Making decisions about your health based on data from the app
• If you have any medical conditions or concerns

You use the training recommendations, AI coaching suggestions, and health-related features at your own risk. Trainavo is not liable for any injuries, health issues, or damages resulting from your use of the Service. If you experience a medical emergency, call your local emergency number immediately.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any data or content

We do not guarantee that GPS, heart rate, or other metrics will be accurate. Data from connected devices, Third-Party Sources, AI systems, and user inputs may contain errors or inconsistencies beyond our control.

13. Beta and Preview Features

We may make alpha, beta, preview, early-access, or experimental features available. These features may be changed, limited, suspended, or discontinued at any time, may be less reliable than generally available features, and are provided for evaluation and feedback. You use beta and preview features at your own risk.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAHLMANN SOFTWARE ApS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages resulting from your use or inability to use the Service
• Any damages resulting from unauthorized access to your data

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty euros (EUR 50), whichever is greater.

15. Indemnification

You agree to indemnify, defend, and hold harmless Dahlmann Software ApS and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties.

16. Termination

You may terminate your account at any time by deleting your account through the app settings or by contacting us at hello@trainavo.com.

We may suspend or terminate your account at our discretion if:

• You violate these Terms
• Your use poses a security risk to the Service or other users
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

Upon termination, your right to use the Service will cease immediately. You may request export of your data before account deletion.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.

18. Dispute Resolution

If you have a dispute with us, we encourage you to first contact us at hello@trainavo.com to seek an informal resolution.

For users in the European Union, you may also submit disputes to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Any legal proceedings shall be brought exclusively in the courts of Denmark, unless you are a consumer entitled to bring proceedings in your country of residence under applicable law.

19. Changes to Terms

We may update these Terms from time to time. When we make changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you of material changes through the app or via email
• Give you reasonable time to review changes before they take effect

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.
